JOHN BRANCA SHOULDN'T HAVE HAD MICHAEL JACKSON WILL IN 2009

Judge Mitchell Beckloff is completely inept in handling Michael Jackson Probate Case.

In January 2003, Michael Jackson's then adviser Ronald Konitzer brought in David LeGrand to investigate some people in Michael Jackson's circle. Mr. Legrand retained an investigating firm named "Interfor". One of the people Interfor investigated was John Branca, Michael Jackson's then Entertainment attorney.

Interfor reported about an offshore bank account co-owned by Tommy Mottola
and John Branca. Sony was transferring money to John Branca.

If indeed John Branca fulfilled his fiduciary duty to Michael Jackson and returned the ORIGINALS of ALL documents, how did he have the originals
of 2002 Michael Jackson Will and Barry Siegel Termination letter in 2009?

Judge Mitchell Beckloff should have subpoenaed Hale, Lane, Peek, Dennison and Howard of Las Vegas (the law firm David LeGrand worked for) to see if John Branca returned Michael Jackson's 2002 Will as instructed in his termination letter.

Judge Mitchell Beckloff should have required John Branca to explain why how in the world he had, in his possesion in 2009, Michael Jackson's 2002 Will and Barry Siegel Resignation letter- 2 documents Branca should ONLY HAVE COPIES of in 2009.

IMPROPER EXECUTION OF THE ALLEGED MICHAEL JACKSON WILL

A Last Will is one of the most important documents a person signs in his lifetime. A Will is the last words of a person. It is essential to the validity of the Will that it is executed properly. An improperly attested Will shouldn't be admitted to the Probate Court.

The witnesses attest that the testator signed the will in their presence on the date and location specified. The alleged Michael Jackson Will was signed on July 7, 2002 in LA.

Michael Jackson wasn't in LA on July 7. He was in New York on July 6-9, 2002

The Estate Executors offered public a ridiculous explanation, it was a "mistake". It was signed in New York. As a matter of fact, even Howard Weitzman, the current attorney for the Estate executors, who wasn't Michael's attorney in 2002, was also in New York, witnessed that Michael signed the purported Will. What a convenient BS!

Michael, 3 witnesses AND Howard Weitzman...ALL 5 of 'em forgot where they were.

The witnesses had only 2 lines to read before signing. How do you not pay attention to the line that comes after "we declare under the penalty of perjury"?  If they weren't lucid to know where they were, how could their veracity in testator's identity be trusted?

MR. JACKSON TOLD ME HE NO LONGER TRUSTED JOHN BRANCA

David LeGrand testified during 2005 Trial. The following is excepts from his testimony.

Q. When did you begin representing Mr. Jackson?

A. It was late January 2003

Q. And approximately when did you cease representing Mr. Jackson?

A. Well, my services were terminated on about March 28th of that year

Q. How did you begin to represent Mr. Jackson?

A. I was introduced to Mr. Jackson through Ronald Konitzer.

Q. You testified that it seemed like everybody around Michael Jackson was interested in profiting, is that accurate?

A. Many people, yes

Q. You investigated some of the people around Mr. Jackson that you were concerned about.  One of the people you investigated was Mr. Branca, correct?

A. Yes.

Q. You were doing it on behalf of Mr. Jackson, correct?

A. Yes.

Q. And at the time, Mr. Branca was an entertainment attorney for Mr. Jackson, right?

A. Yes.

Q. And Mr. Branca was a partner at the Ziffren law firm in Los Angeles, correct?

A. Yes.

Q. That firm also represented Sony, correct?

A. I believe the answer is correct. Yes.

Q. The Sony/ATV catalog was owned 50/50 by Sony and Michael Jackson, correct?

A. Yes

Q. You were aware that negotiations went on from time to time between representatives of Michael Jackson and representatives of Sony about their respective interests in that music catalog, right?

A. Well, absolutely, yes, because I obtained files from the Ziffren law firm evidencing the Ziffren law firm and Mr. Branca, representing Mr. Jackson, in just such discussions over a period of time.

Q. Why did you investigate Mr. Branca?

A. Because Mr. Konitzer had indicated in several conversations that he was very concerned about Mr. Branca and that Mr. Jackson had expressed concern about Mr. Branca’s loyalty.

Q. Do you recall asking Interfor to do some investigation into an offshore bank account?

A. It’s kind of the other way around. We asked Interfor to investigate Mr. Branca. They indicated to us that --

Prosecution: I’m going to object based on hearsay.

Mesereau: State of mind, Your Honor.

Court: Sustained.

Q. Isn’t it true that you were trying to investigate offshore accounts owned by Branca and someone named Tommy Mottola?

A. Yes.

Q. Who was Tommy Mottola?

A. He was a very powerful figure in the record industry at one time. I believe he was the president of the Sony Entertainment Division in the U.S.

Q. Did you investigate the existence of an offshore bank account?

A. We requested Interfor to look into that possibility, yes.

Q. Why?

A. Because we were given information from a source that appeared to have some credibility that such an account existed.

Q. And why did you want to investigate that account?

A. Well, to me, that’s kind of obvious. If, in fact, there was an offshore account in which money was being deposited for the benefit of Mr. Branca, that would indicate very serious violations of Mr. Branca’s responsibilities to Mr. Jackson.

Q. At your direction, they looked into the existence of that account, correct?

A. Yes.

Q. Where was this offshore account? 

A. I believe it was in the Caribbean

Q. The investigation did indicate Branca was involved in the account, correct?

A. The investigator’s report so indicated.

Q. And the report indicated that Sony was involved in that account, right?

A. The investigator’s report indicated that Sony transferred money to the account.

Q. Sony transferred money to that account for the benefit of Mr. Jackson’s lawyer, right?

A. That’s what was indicated in the report.

Q. Do you know why there was a decision to clean house in Mr Jackson’s business?

A. Well, I know what Mr. Jackson told me.

Q. All right. Why don’t you just tell me what Mr. Jackson told you.

A. Mr. Jackson told me that he no longer had confidence in John Branca.

Q. And in part of this cleaning of house, Mr. Jackson decided to personally fire his attorney (John Branca) who he had been with him for more than a decade?

A. Yes.

Q. And he wrote a letter dismissing that attorney, didn’t he?

A. Yes.

Q. You did that because that’s what he told you he wanted to do?
A. Yes.

The following questions by Tom Mesereau were asked but sustained by court after
the prosecutor objected. But Tom Mesereau managed to get them on record. Michael Jackson was sitting in that court room while his attorney presented the following questions. Implications speaks volumes of Michael's feelings re: John Branca.

Q. You were concerned that Mr. Branca and that law firm might not be representing Mr. Jackson’s interests properly because of their connection to Sony, correct?

Q. Didn’t you investigate Mr Branca because you were concerned that he and Sony had set up an offshore account to funnel money to so they could defraud Michael Jackson?

Q. Did you think that Sony was paying Mr. Branca money to sell out Mr. Jackson?

Q. And you were concerned that all of these characters were trying to steal money and take advantage of Michael Jackson, right?

Q. And it was your direction that they look into that account because you were concerned that Michael Jackson’s attorney and Sony were putting money in that account so Mr. Jackson’s lawyer would essentially sell him out, right?

JOHN BRANCA DIDN'T "RESIGN" IN 2006

The lie commenced with the Press Release publicising the alleged Michael Jackson Will. It claims that John Branca "represented Mr. Jackson from 1980 untill 2006".

Notice how the Press Release conveniently left out John Branca's 2003 Termination?

This Branca apologist blog admits that Branca was indeed fired in 2003 but states that "Michael MUST HAVE realized that John Branca did not embezzle any money because in November of 2003, Branca was once again Michael Jackson's attorney."
The blogger refers to an article from New York Times: "John Branca, Mr. Jackson's lawyer, did not return a phone call seeking comment". Well, sure he didn't because he was NOT Michael's lawyer. Branca termination letter surfaced AFTER Michael's death. Neither fan community nor media were aware that Michael fired John Branca in 2003.

The blogger cites several other news links from 2004 by various media outlets that referred to John Branca as Michael's attorney. There is even one "objective" article  dated June 9, 2005 by Times Online that Michael "is being advised by John Branca,
a well-known music industry lawyer, and Charles Koppelman."

Does it make any sense that Branca was rehired in 2003, he was employed
by Michael until 2006, he even "negotiated Michael's loan in June 2005" yet
in April 2005 Mesereau blasts Branca of "not properly representing Michael due to close connection to Sony", "funneling money to defraud", "stealing money and taking advantage of Michael", "selling out Michael" and conspiring against Michael to rob his interest in Sony/ATV?  All the while Michael tacitly listening to Mesereau libel his "CURRENT" attorney Branca?

Frank Dileo also came into Michael’s life during 2005 Trial. Neither John Branca nor Frank Dileo was rehired, they were merely landing their support to Michael Jackson.

NO HONOR AMONG THIEVES!

It appears that Katherine Jackson is bling-blinging with John Branca’s balls!

I would have gained respect for Mr Branca if he litigated Katherine and proceeded litigating Melissa Johnson & Howard Mann so that future illegal exploitations could be discouraged. The lawsuits against Mann & Johnson were open and shut cases!
The Estate could have gained reparations from Howard Mann & Melissa Johnson.

The Executors settled on the 11^th hour with Melissa Johnson, instead paying HER and other vultures associated with her. Whilst the details of the settlement are sealed, we know that the trademarks that Melissa Johnson owned will be turned over to
the Estate. Heal the World Foundation will be revived & controlled by the executors.

I stood by the executors regardless of my personal feelings towards them because
I THOUGH that their intentions were honarable. Now I realise that the agenda was NOT to protect Michael’s interests at all. Perhaps Melissa Johnson was correct when she alleged that Executors began having problems with her ONLY WHEN they noticed that there was money to be made and the executors weren’t getting their cuts!

Let’s do a recap, shall we?

Branca accused Melissa Johnson to be instable and obsessive fraud that posed a “security risk”. He said he would "NEVER ALLOW" her to be involved "IN ANY WAY"

Katherine Jackson & Melissa Johnson accused John Branca to be a thief who hijacked Michael’s Estate fraudulently.

How can anyone, examining the full picture respect this settlement? 

The Executors bemoaned that Melissa Johnson is a fraud then collaborate with her! What does this settlement say about the reasoning of the executors? They stated that Melissa Johnson was a “security risk” now they give her
a seat next to Katherine Jackson and Michael’s children.
                                      How ludicrous is this?

Melissa Johnson was the “heroine” aspiring to save the day by revealing Branca as a thief that hijacked Michael’s Estate. Yet she now shakes hands with this thief?

“Mr Branca was a man that my son was worried about. Michel told me on more than one occasion that he did not like this man and did not trust him. He told me that John had stolen from him “declared Katherine Jackson.

I doubt that Michael discussed his business affairs with Katherine. Yes, I am calling her a liar! She lied about her declaration, she lied on Oprah, she lies under oath.
But for argument’s sake, let’s say that Michael did confide in Katherine that Branca stole from him and he didn’t trust Branca. Why didn’t she contest the Will? When Katherine doesn’t get her way, she whines about Branca's legitimacy but he is
an allright fella' as long as he placates her which always involves mo' money!

I have no reason to believe that Katherine is charitable! She is doing what she is doing because she profits from the settlement!


If she is indeed an altruistic person, she should facilitate payment for Jermaine's over $100,000 back child support! You don't care about the wellbeing of your OWN grandchildren, don't expect public to buy that you care about the world children!

If MICHAEL wanted his mom and dad to be part of his charity, he would have put them on the Board. Katherine and Joe were not in Michael’s Heal the World Foundation Board, what purpose could their appointments possibly serve now? Joe Jackson name in connection with a charity is COMICAL! He would rob from homeless! Will any member of the Jackson Family put their money where their mouths are and donate to the Heal the World Foundation out of their own pockets? Yeah right!

I wouldn’t be surprised if the %20 from Michael’s Estate is divided among these vultures and not a penny goes to a charity! I believe the Heal The World Foundation is tainted and it will be used to funnel money to everyone involved in this settlement. Branca conveyed the nature of the Foundation the best:

“In reality, this ‘charitable organization’ is merely a subterfuge to turn a profit,
using Mr Jackson’s name and likeness.” ~JOHN BRANCA

Melissa Johnson had authorized Howard Mann to exploit his wares through the trademarks she owns, which are now being transferred to Michael'sEstate. The settlement is bound to include a payout to Howard Mann, Melissa Johnson and Katherine Jackson. Executors get paid for their time for the lawsuit. All these
monies are coming out of...you guessed it...Michael’s pocket!

This settlement, bluntly put, is another way for vultures to exploit Michael.

Dear Michael Jackson Fan:

You will see in the previous post that Heal the World Foundation is merely
a middleman to pass your donations to various charities. The expenses of the foundation comes out of your donations. This was Michael's "utmost concern".

You do NOT need Heal the World Foundation to honor Michael and "Make That Change". Donate to legit charities of your choice directly!

John Branca WILL sell Michael's share of Sony/ATV to Sony

Why hasn’t John Branca sold Michael’s half of the Catalog to Sony yet?

- Sony is still the financial backer for the $300 million loan until September 2011

- Sony's revenue dropped %11 in its second fiscal quarter, ended Sept 30, 2010. Sony is depending on the New Michael Jackson Album to raise its revenues next quarter. It would be a publicity nightmare for Sony to buy Michael’s stake of the Catalog now, confirming whispers that Michael was killed for his Catalog

"They want my Catalog, they will kill me for it" -MICHAEL JACKSON

Such move would contribute negative publicity to the new Michael Jackson album, adversely affecting Sony’s Revenue and Branca’s Executor Fee.

- Michael’s Alleged Trust is not properly funded. Moving Michael's assets into his Trust would have protected them from creditors. There are too many claims against the Catalogs by those who hold them as collateral.  That is a hassle Sony prefers, John Branca deal with.

- Why just own Beatles Catalog when posthumously MiJac struck gold? 

MiJac, which holds Michael's own songs, including previously unreleased material has become one of the most valuable music catalogs in modern music history. Executors will generate enough funds to settle outstanding debt, clearing both Sony/ATV & MiJac Catalogs. Then Mijac which soared in value after Michael’s death will be merged with Sony/ATV before Branca brokers it to Sony.

- The Sony/ATV Catalog is worth about $2 billion. Rendering $1 billion to MJ Estate isn't currently financially feasible to Sony. Michael no longer borrows against Sony/ATV so Sony no longer worries about half of the joint venture ending up at Bankruptcy Court, no sense of urgency.

- Like John Branca, Frank Dileo and Joel Katz who CLAIM to be “hired” by Michael right before his death are on Sony/ATV board. Sony aspired total control of the Sony/ATV operations. With Branca, Dileo and Katz on its side, Sony HAS full control of the Sony/ATV.

It isn't the matter of IF Branca will sell BOTH MJ Catalogs to Sony, it is WHEN.
